Initiation of Antidumping Investigation - BOPP Film |

The National Tariff Commission (the Commission) had earlier on September 27, 2010 initiated an antidumping investigation against alleged dumping of BOPP Film originating in and/or exported from the People’s Republic of China, Sultanate of Oman, Kingdom of Saudi Arabia and United Arab Emirates. The application for initiation of this investigation was prepared and filed by us on behalf of the domestic industry of BOPP Film in Pakistan namely M/s. Tri-Pack Films Limited, Karachi. However, the decision of the Commission for this initiation was challenged in the Islamabad High Court because of non-completion of quorum of the Commission at that time. Now in an order dated March 10, 2012, the said Honorable Court has ordered the Commission to proceed afresh on the complaint with the Commission.
In accordance with the above decision of the Honorable Court, the Commission has re-initiated this investigation on April 23, 2012. As per the notice of initiation the Commission has indicated that the date of its preliminary determination will be no earlier than 60 days and not later than 180 days from the date of initiation of the investigation.

Conclusion of Sunset Review Investigation-Formic Acid 85% |

National Tariff Commission of Pakistan (the Commission) has continued antidumping duties ranging from 6.25% to 13.63% for another period of 5 years w.e.f March 09, 2011 against dumped imports of Formic Acid 85% from Finland and Germany. These antidumping duties have been continued as a result of conclusion of a Sunset Review of antidumping duties which were earlier imposed on both these countries for a period of 5 years from March 09, 2006 to March 08, 2011. Therefore, on the whole the domestic applicant industry has been protected against dumped imports from Finland and Germany for a period of 10 years from March 09, 2006 to March 08, 2016.

Application for this review investigation was prepared and filed by us with the Commission on behalf of our client (M/s. Tufail Chemical Industries Limited who is a major local producer of this product). We pursued this case throughout the period of this review investigation and with the help of our continued and concerted efforts, the Commission was able to determine likelihood of dumping and injury although during the period of review there were no imports of the product concerned from the dumped sources. It is also a matter of great honour for us, that for this client even earlier application filed 7 years ago was prepared and pursued by us.

Final Determination AD - Formic Acid (85% & Above) |

National Tariff Commission of Pakistan (the Commission) has imposed antidumping duties as per Final Determination made on February 10, 2012 against dumped imports of Formic Acid 85% and Above into Pakistan from China and South Korea ranging from 3.48% to 44.10% for a period of 5 years w.e.f February 10, 2012. Country wise final antidumping duties are as follows:
China:
i) BASF-YPC : 3.48%
ii) All Others exporters/foreign producers : 13.84%
South Korea – All exporters : 44.10%
We, on behalf of our client M/s. Tufail Chemical Industries Limited, Karachi, prepared and filed the application with the Commission under Section 20 of the Anti-Dumping Duties Ordinance, 2000 (the “Ordinance”). M/s. Tufail Chemical Industries Limited, Karachi is the major producer of Formic Acid 85% and Above in Pakistan. We pursued this case throughout the period of investigation and with the help of our continued and concerted efforts, the Commission was able to determine dumping specially against major exporter from China against whom the Commission could not determine dumping till its preliminary determination.

Conclusion of PFY Sunset Review |

On Saturday, December 10, 2011 the National Tariff Commission of Pakistan (NTC) has concluded the Sunset Review of Antidumping Duties imposed @ 10.94% on dumped imports of Phthalic Anhydride from Republic of India. As a result of this conclusion, NTC has extended the imposition of antidumping duty for another period of 5 years, on imports of Phthalic Anhydride from India. We on behalf of our client (M/s. Nimir Chemicals Pakistan Limited) prepared, filed and defended this application with the NTC.

First Ever Initiation of Anti-Subsidy Case: |

National Tariff Commission (the Commission) on November 23, 2011 has initiated an anti-subsidy investigation against subsidized imports of Certain Writing/Printing Paper into Pakistan originating in and/or exported from Indonesia and Thailand. We prepared and filed this anti-subsidy case with the Commission on behalf of our client M/s. Packages Limited, Lahore.
This is the first initiation of an anti-subsidy case in the history of the Commission in the last more than 10 years period since promulgation and implementation of the Countervailing Duties Ordinance 2001. We are very much confident that the success of this case would pave the way for likely success of prospective anti-subsidy cases of other domestic industries effected by subsidized imports from these countries amongst others.

First Ever Successful Newcomer Review for Foreign Exporter: |

National Tariff Commission (the Commission) on Oct 14, 2011 has concluded a newcomer review against the definitive antidumping duties imposed on dumped imports of Polyester Filament Yarn originating in and/or exported from the South Korea. Our client M/s. TK Chemical Corporation from South Korea succeeded in getting zero percent (-0.78%) individual dumping margin as a result of conclusion of a newcomer review. We prepared and filed this newcomer review application with the Commission on behalf of our client.
This is the first case of a newcomer review in the history of the Commission in the last more than 10 years since the promulgation and implementation of Antidumping Duties Ordinance 2000, in which a foreign exporter got zero percent antidumping duty. We are very much pleased and honored to be part of this success of our Korean client.

Final Determination of Antidumping Investigation - Phthalic Anhydride |

National Tariff Commission (the Commission) has imposed Antidumping Duties as per Final Determination made on September 30, 2010 against dumped imports of Phthalic Anhydride into Pakistan from Brazil, China, Indonesia, South Korea and Taiwan ranging from 5.87% to 27.28% for five years from September 30, 2010. Country wise final antidumping duties are as follows:
Brazil: All exporters 6.17%
China: All exporters 11.84%
Indonesia: PT. Petrowidada 5.87%
All others Indonesia 5.87%
South Korea: All exporters 7.36%
Taiwan: All exporters 27.28%
We, on behalf of our client M/s. Nimir Chemicals Pakistan Limited, Lahore, prepared and filed the application to the Commission under Section 20 of the Anti-Dumping Duties Ordinance, 2000 (the “Ordinance”). Nimir Chemicals Pakistan Limited is the major producer of Phthalic Anhydride in Pakistan. Nimir Chemicals Pakistan Limited represent 100 percent of the total production of Phthalic Anhydride in Pakistan during the period from January 01, 2009 to December 31, 2009.
The Commission initiated the investigation pursuant to Section 23 of the Ordinance after examining the adequacy and accuracy of the information/evidence provided in the application and having been satisfied that (i) the application has been made by the domestic industry; (ii) there is sufficient evidence to justify initiation of an investigation. In its final determination, the Commission determined that Phthalic Anhydride originating in and/or exported from the Exporting Countries was dumped into Pakistan and such dumping caused and/or is causing material injury to the domestic industry.

Preliminary Determination of Antidumping Investigation-Hydrogen Peroxide (H2O2) |

National Tariff Commission (the Commission) has imposed Antidumping Duties as per Preliminary Determination made on September 27, 2010 against dumped imports of Hydrogen Peroxide (H2O2) into Pakistan from Belgium, China, Indonesia, South Korea, Taiwan, Thailand and Turkey ranging from 3.82% to 84.48%. Country wise preliminary antidumping duties are as follows:
Belgium: Evonik Degussa, Germany and Evonik Degussa, Belgium 9.20%
All others Belgium 84.48%
South Korea: Evonik Degussa, Korea and Evonik Headwaters 14.77%
All others South Korea 14.77%
Thailand: Thai Peroxide 3.82%
All others Thailand 25.04%
Indonesia: Evonik Degussa, Indonesia 25.20%

Descon Oxychem Limited, Lahore, prepared and filed the application to the Commission under Section 20 of the Anti-Dumping Duties Ordinance, 2000 (the “Ordinance”). M/s. Sitara Peroxide Limited, Faisalabad and M/s. Descon Oxychem Limited, Lahore are the major producers of Hydrogen Peroxide (H2O2) in Pakistan. They represent 100 percent of the total production of Hydrogen Peroxide (H2O2) in Pakistan during the period from April 01, 2009 to March 31, 2010.
The Commission initiated the investigation pursuant to Section 23 of the Ordinance after examining the adequacy and accuracy of the information/evidence provided in the application and having been satisfied that (i) the application has been made by the domestic industry; (ii) there is sufficient evidence to justify initiation of an investigation. In its preliminary determination, the Commission determined that Hydrogen Peroxide originating in and/or exported from the Exporting Countries was dumped into Pakistan and such dumping caused and/or is causing material retardation of the establishment of domestic industry.
